Nicholas Smith had the privilege of attending the annual Sir Michael Davies Lecture of the Expert Witness Institute at the Royal Air Force Club.
It was a pleasure to meet Lady Simler, Justice of the Supreme Court (the new President of the EWI), and to thank Lord Hodge, Deputy President of the Supreme Court, the outgoing President, for his invaluable contribution and leadership over the past years. Lady Simler delivered an inspiring address — one that truly sets out a blueprint for all expert witnesses to follow in maintaining integrity, independence, and excellence in expert evidence.
Thanks also go to Sir Martin Spencer, Justice of the High Court (our Chair of the Board), and Simon Berney-Edwards our CEO for their efforts in organising such an engaging and thought-provoking evening.

Efstathios Maliakis attended the MEECON (Middle East Energy Conference) in October at the Waldorf Astoria, Dubai International Financial Centre. The room was fully packed with insurance and loss-adjustment professionals.

The market in a nutshell
Latin America is not one market, it is a collection of countries, each with its own standards, codes, and practices. Brazilian NBR (Normas Brasileiras Regulamentadoras), Colombian NSR (Norma Sismo-Resistente de Colombia), Peru RNE (Reglamento Nacional de Edificaciones) and Mexican NOMs (Normas Oficiales Mexicanas) all differ, while many major projects are governed by FIDIC or EPC contracts financed by multilaterals such as the IDB or World Bank.

🏗️ Big win for expert-led analysis in complex construction disputes
I’d like to share a compelling judgment in Santos Limited v Fluor Australia Pty Ltd & Fluor Corporation [2025] QSC 184 (link below) — a case that reinforces the decisive role of robust, transparent expert evidence in major EPC disputes.
🔍 Key findings (Delay & Quantum)
The Court endorsed the referees’ reliance on Santos’s delay expert, whose analysis followed principles consistent with the SCL Protocol, over Fluor’s hybrid “near-critical path” method.
On quantum, the referees’ findings on recoverable Time-Related Indirect Costs (TRICs) and overpayments were upheld, while Fluor’s cost evidence was rejected as inconsistent and lacking transparency.
Fluor’s “conduct defences” — estoppel, waiver, and reliance on prior certifications — were all dismissed.
🏛️ Why this judgment matters
It shows that expert reports prepared with clarity, rigour, and alignment to recognised standards (e.g. SCL Protocol, EWI guidelines) carry significant weight in the eyes of courts and tribunals.
Conversely, methodologies that deviate from accepted practice or fail to disclose underlying logic risk being discounted entirely.
📚 Learning from major cases
Whilst DAC Consulting Services was not involved in this case, we have read it with great interest — particularly the Court’s emphasis on disciplined expert methodology and transparency. Cases like this provide valuable lessons for all practitioners involved in delay and quantum evidence.
